Terms & Conditions
When you agree to an exchange with another member you are bound by these terms & conditions. It will be presumed that you have read and understood them.
The swap must be with the property that is actually shown on the website; no substitute can be made unless agreed with the prospective swapping member. The contract to swap is with the members involved and not EHH and so the guest is subject to the usual terms and conditions of the holiday home they are going to.
All members must own holiday homes. Fractional Ownership properties may be acceptable as long as the owner has at least 25% ownership of the property, but email us to discuss. Individual Time Share properties are not acceptable for membership of EHH due to lack of flexibility.
To be fair and make the standard the same for all Exchange Holiday Homes (thereon in known as EHH) members electricity, oil, gas, bed linen and final cleaning costs, should be the responsibility of the owners and included in the exchange (as this is not a rental booking but an exchange club and all holiday home owners have these costs). Any extra costs such as electricity by coin meter, logs, towels, should be stated on the swap details. Security deposits can be requested if you normally do so, but members should add the details to their listing. Please Note that to qualify for the extra credits for more bedrooms you must be able to sleep 4 or more in a 2 bedroom property, 5 or more in a 3/4 bedroom property, 9 or more in a 5/6 bedroom property..
You (the member) are responsible for the security of your user name and password and should not give out the information to any other party. Should a family member or friend wish to use your membership you must be the one that makes the booking and you will be held responsible for their behavior. Friends and family of any member that use this service via that member are held by these terms & conditions and it is the responsibility of that member to make sure that they have access to the T&C's and have read them. You, the member are held responsible for your friends and family should they use your membership to visit another member's property.
You (the member) are responsible that the information that is shown on this website about your property is accurate and correct. If any changes have taken place that effects or changes the information about the property on this website then it is your responsibility to notify EHH immediately of such changes. We reserve the right to add more information to any advert , should we deem it necessary ( for example, location details) You are only eligible for extra credits for a swimming pool/hot tub, should the pool/hot tub be in use on the dates agreed. If the pool/hot tub is not available for use then the extra credits will be deducted for that week should it be booked. It is your duty to inform us if it is not available at any time ,if you have registered a swimming pool/ hot tub with us. Please note that a whirlpool/jacuzzi bath is not classified as a hot tub and so is not eligible for extra credits.
All members holiday homes should be in a clean, suitable condition, as described and shown on the listing. If this is not case when a guest visits, and photograohic proof can be shown of that, then we have the right to remove all or some of the credtis earned by the booking.. Members staying in the holiday homes should leave them as they find them, and treat them with respect and care. Any damage no matter how large or small must be paid for, although this is not a concern for EHH and must resolved between members. If any information that is shown on the listing is found to be seriously misleading then we reserve the right to remove you as a member immediately for the protection of our members with immediate effect. Any credits earned with be lost.
Any guest wishing to bring pets to a property must first agree it with the owner. As a guest you must not exceed the max number of persons allowed at the property you are visiting. Should any damage be caused by pets that member must immediately pay for the damage. If EHH finds out that a pet has been to a property without the owners permission EHH have the right to cancel that persons membership immediately, all their credits will be lost.
Should you request the return of a banked week (and it has not been booked by one of our owners) we will return that week to you. However if you owe credits, any week returned to a member must be replaced with another week (of equivalent credit value) should it take you into negative credit value. Negative credit value being when you have used credits but they have not yet been cancelled out by one or more of your weeks being used by another member. If you have taken any exchanges ( you can take up to 2 exchanges before any credits have been earned back) you must at all times, have dates showing to cover the same amount or more credits unitil such time the credits have been earned back.
If you do not remove a week before you rent it out to someone and we contact you re an exchange to find it not available then we will deduct 7 points from your credits. This is so that we are only showing weeks that are available to exchange to avoid disappointment for all our members. If this happens more than once we will have no alternative but to review your membership and you may lose any credits you have in hand. So make sure all weeks you have booked out yourselves are immediately removed from our lists.
Once any already 'banked' weeks are 6 weeks or less away, they will be advertised to our members (and their friends & family) at a discounted credit rate. Any weeks that are within the next 6 weeks but specifically requested by another member and added for that member are not eligible for the discounted late offers credit rate. The discounted rates are for weeks that have been previously advertised on EHH and have not been selected. The member that owns those weeks will get the full credit value. These weeks are not shown to the general public and are only available for members to view on our website.
Photos must be added to your property's details before you are added onto our system or made a full member. Until such time the photos have been added you are not able to participate or use any credits. A reasonable amount of text must be added stated the number of bedrooms, bathrooms, heating, garden/balcony etc. If we deem that the information is not details we will contact you and if you do not add more information (or send it to us to add for you) after we have reminded you twice then we have the right to remove your property from our books and you will lose all credit earned.
Any annual costs that are due on your property (maintenance, rates, ground rent etc) must be paid in full with regard any weeks banked with us. All normal household bills are the responsibility of the owner of the property. The property must be covered by house insurance whilst members (or their friends and family) are visiting as guests.
EHH can not be held responsible for any damage caused. EHH can not be held responsible for consequences that may arise because of any exchange or cancellation. EHH can not be held responsible for any cancellations whatsoever, we recommend travel insurance be taken out prior to your holiday. EHH recomend you contact the host member to confirm all arrangements before you book flights, ferries or any other travel arrangement. The host and guest members shall indemnify EHH against all claims, expenses, costs, losses, damage, destruction and any liabilities whatsoever that occur during a member ( or their friends and family) visit or as a result of inaccurate information provided by the host member, or as a result of the host or guest member canceling the visit.
The membership is not transferable, it is the duty of the member to inform EHH should the holiday home be sold. A member can terminate their membership at anytime, but any weeks that have been booked and agreed upon must be honored.
If a guest member cancels a week that another member has booked, the exchange fee and credits are non returnable. All credits will be lost by the member that cancels. The owner of the property does not lose the credits that have allocated to him for that week. We reserve the right to re offer that week and if it is re booked , the owner will receive those credits, in addition to the credits previously allocated.
Once agreed with each member, and the exchange payment received , the booking forms are sent out and the the booking is deemed as confirmed and legally binding. We do requst the booking form to be returned signed, only so we know that the owner has received them and is able to contact the guest members. If a Host member cancels and you can not agree a satisfactory (for both members) alternative date, the guest will be refunded the credits. The total exchange fee that the guest has paid will be charged to the Host Member plus a penalty fee of £156. .Once recovered the fees paid by the guest will be returned. We reserve the right to terminate membership of the Host member should there be an unsatisfactory reason for the cancellation of the booking. We request that the guest member makes sure that they contact the host member within the first week of receivng the booking form,, if they do not , they will not be entitled to a refund of creditis should a canccellation occur. The exchange fee will be credited to their account only, for use with their next exchange.
If your membership is cancelled or If you wish to cancel your membership before credits you have used have been cancelled out by another member using your own weeks, then you will be liable to pay the credit value you have used for any exchanges at the rate of £39 per 7 credits immediately plus an admin charge of £40 .. EHH reserve the right to cancel your membership without notice and with lose of all credits owned should any of these terms and conditions be breached.
Any breach of these terms & conditions which are non negotiable, will be pursued by Exchange Holiday Homes via a court of law without exception
We cannot be held responsible for any circumstances that should occur once an exchange is agreed. If any member puts their property up for sale during thier membership with EHH, they must inform EHH. If they do not, we reerve the right to terminate their membership without notice and any credtis earned will be lost. Any exchanges agreed may be terminated and they will be liable for the guest exchange fees charges plus an admin charge of £25.
EHH can not be held responsible for any descriptions given on the website, EHH is just an information service and has no way of checking that any information given by it's members is accurate. . It is the responsibility of the potential swappers to verify all the information. We highly recommend that you contact the owner of the holiday home you are visiting to confirm all the necessary details and queries with them.
We can not be held liable for any misrepresentation or the failure of any exchange arrangement through whatever causes. You hold the responsibility of using EHH at your own risk and should you not be satisfied with EHH , the website or these terms and conditions then it is your responsibility to sever your membership with EHH.
EHH provide a network service to advertise holiday home swaps and introduce owners. We aim to provide an uninterrupted service but there may be times when for reasons beyond our control when the system/server is temporarily unavailable, so EHH can not guarantee uninterrupted without fail. Whilst EHH hold the lists for a specified period we can not be responsible should they be lost, stolen or damaged.
EHH reserve the right to change these terms from time to time and so recommend that you look at the terms and conditions when you access this website. You may not use the name EHH, Exchange Holiday Homes or any logo associated with it without permission by EHH.
